These Terms & Conditions govern your use of the Three Little Cubs website and your purchase of products and services from Three Little Cubs Ltd.

By using our website or placing an order, you acknowledge that you have read and understood these Terms & Conditions. Your statutory consumer rights are not affected by these Terms & Conditions.

Nothing in these Terms & Conditions affects any rights or protections that cannot legally be excluded or limited under the laws applicable to you.

By using this website, you confirm that:

  • you will not misuse, interfere with or attempt to gain unauthorised access to the website or its systems.

The content of this website is provided for general information and may be changed or updated from time to time.

We make reasonable efforts to ensure that information on the website is accurate, but we do not guarantee that all information will always be complete, current or error-free.


3. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time.

Any changes will apply from the date they are published on this page. We recommend checking this page periodically for the latest version.

Changes to these Terms & Conditions will not affect orders that have already been accepted unless required by law.

We may also temporarily or permanently modify, suspend or withdraw parts of the website where reasonably necessary.


4. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, colours, dimensions and other information on our website are accurate.

However, colours may appear differently depending on your device or screen settings.

Our products are handmade or may contain handmade components. Where applicable, slight variations in colour, texture, finish, dimensions or appearance may occur.

For products made using recycled materials, including recycled cotton cord, colour and texture may vary between production batches.

Where a product is made to order, the product description will provide the applicable estimated production or dispatch timeframe.


5. ORDERS AND CONTRACT FORMATION

When you place an order through our website, you are making an offer to purchase the products selected by you.

After placing an order, you may receive an automated order confirmation. This confirms that we have received your order but does not necessarily mean that we have accepted it.

A contract between you and Three Little Cubs Ltd will be formed when we accept your order and, where applicable, begin processing or preparing it for dispatch.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • the product is unavailable;

  • there has been an obvious pricing or listing error;

  • we reasonably suspect fraudulent or abusive activity;

  • there is an error in the order information; or

  • circumstances outside our reasonable control prevent us from fulfilling the order.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.


6. PRICES AND VAT

All prices displayed on our website are in UK Pounds Sterling (£).

Where applicable, prices include VAT at the current rate.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.

If there is an obvious pricing error on the website, we reserve the right to correct the error and, where necessary, cancel the affected order and provide a full refund.


7. PAYMENT

Payment can be made using the payment methods available at checkout, which may include:

  • Stripe – debit or credit card

  • PayPal

Payment must be successfully authorised before an order can be processed.

We do not store your full payment card details. Payment information is processed by the relevant payment provider in accordance with its own terms and privacy policies.


8. SHIPPING AND DELIVERY

We currently ship physical products within Great Britain only.

We do not currently ship physical products to Northern Ireland or outside the UK.

Digital products are available for purchase worldwide.

Delivery times shown on the website are estimates unless a specific guaranteed delivery service has been purchased.

Once physical goods have been delivered to you, or to a person identified by you to receive them, the risk in the goods will pass to you, subject to your statutory rights.

You are responsible for providing an accurate and complete delivery address.

If an order is returned to us because an incorrect or incomplete address was provided, we may require payment of the applicable additional postage cost before the order is resent.


9. CANCELLATIONS, RETURNS AND REFUNDS – PHYSICAL PRODUCTS

Where applicable, consumers have statutory cancellation rights in relation to physical goods purchased online.

Our Returns & Refund Policy provides further information about returning physical products and should be read alongside these Terms & Conditions.

Unless otherwise required by law, returned items must be unused and in their original condition and packaging where applicable.

You may be responsible for the cost of returning unwanted goods where permitted by law.

Nothing in these Terms affects your statutory rights in relation to faulty, defective, damaged or misdescribed goods.


10. DIGITAL PRODUCTS

Digital products include, but are not limited to:

  • crochet patterns;

  • PDF patterns and instructions;

  • video tutorials;

  • digital guides;

  • downloadable templates; and

  • other downloadable or electronically supplied content.

Digital products are supplied as digital content only. Unless expressly stated otherwise, no finished physical product, materials or physical kit is included with the purchase of a digital product.

Digital products may be supplied immediately or shortly after purchase by download link, email or another electronic delivery method.

Digital Downloads, Cancellations and Refunds

Please carefully check the product description and ensure that you have selected the correct digital product before completing your purchase.

Due to the nature of digital content, once a digital product has been downloaded, accessed or otherwise supplied, we are generally unable to offer a refund for change of mind, accidental purchase, ordering the incorrect product or simply deciding that the product is no longer wanted, except where a refund or other remedy is required by applicable law.

Where applicable consumer law provides a cancellation period for digital content, you may be required to expressly consent to the immediate supply of the digital content and acknowledge that your statutory right to cancel may be lost once the digital content has been supplied or accessed.

By purchasing and accessing a digital product, you acknowledge that the product is supplied electronically and that the digital content may be made available to you immediately following purchase.

Accidental Purchases

If you have accidentally purchased a digital product, please contact us before downloading or accessing the product.

Where the digital content has not yet been supplied or accessed and applicable law permits cancellation, we may cancel the order and issue a refund.

Once a digital product has been downloaded or accessed, we will not normally provide a refund for an accidental purchase, change of mind or incorrect product selection, subject to any mandatory consumer rights that apply to you.

Faulty or Defective Digital Content

Nothing in these Terms & Conditions excludes, restricts or limits any consumer rights or legal remedies that cannot lawfully be excluded or limited in your country.

We will investigate the issue and, where appropriate, provide a replacement file, correction or other remedy.

Where applicable consumer law provides you with a right to a repair, replacement, price reduction or refund, we will comply with those legal requirements.

If you experience a technical problem downloading or accessing your purchase, please contact us before requesting a refund. We will make reasonable efforts to resolve the issue and restore access to the digital content.

Worldwide Digital Purchases

Our digital products are available for purchase and download worldwide.

Consumer protection laws vary between countries. These Terms & Conditions are intended to apply to customers worldwide, but nothing in these Terms & Conditions is intended to remove, restrict or override any mandatory consumer rights that apply to you under the laws of your country or jurisdiction.

Where the law applicable to your purchase gives you rights or remedies that cannot legally be excluded or limited, those rights will continue to apply regardless of anything stated in these Terms & Conditions.

Digital Product Refund Requests

All refund requests relating to digital products will be considered in accordance with these Terms & Conditions and the mandatory consumer laws applicable to the purchase.

Downloading or accessing a digital product confirms that the digital content has been supplied to you. Once downloaded or accessed, refunds are generally not available for accidental purchases, change of mind or incorrect product selection, unless required by applicable law or where the digital content is faulty, defective, misdescribed or otherwise fails to meet your legal rights.

Intellectual Property and Use of Digital Products

All Three Little Cubs digital patterns, instructions, photographs, videos, tutorials and associated content remain the intellectual property of Three Little Cubs Ltd.

Purchasing a digital product gives you a personal, non-transferable licence to use the purchased content. It does not transfer ownership, copyright or intellectual property rights to you.

You must not:

  • copy or reproduce the digital product;

  • share the digital file with another person;

  • upload the digital product to websites, groups, forums, file-sharing services or social media;

  • resell or redistribute the digital product;

  • publish the pattern or tutorial, in whole or in part;

  • distribute screenshots or copies of the pattern;

  • translate and distribute the pattern without our written permission;

  • claim the pattern, instructions or design as your own; or

  • use the pattern or tutorial to create and distribute another pattern, tutorial or instructional product.

Permission to sell finished items made using a Three Little Cubs pattern, where expressly permitted by the individual pattern, does not give permission to sell, share, copy or distribute the digital pattern or tutorial itself.

Any commercial-use permission provided with a particular pattern is subject to the specific terms stated within that pattern.


11. MOSES BASKET DIGITAL PATTERNS AND TUTORIALS

Our Moses Basket digital patterns and tutorials provide instructions only.

No finished Moses basket is included with the purchase of a digital pattern unless expressly stated otherwise.

Before purchasing, downloading or using a Moses Basket pattern or tutorial, you must read the accompanying Three Little Cubs Moses Basket Pattern & Tutorial Disclaimer.

The Pattern & Tutorial Disclaimer forms part of the terms applicable to your use of the digital pattern and contains important information regarding:

  • safety and intended use;

  • infant safety;

  • supervision;

  • BS EN 1466:2023 testing;

  • maker and seller responsibility;

  • materials and construction;

  • modifications;

  • liability;

  • international use;

  • copyright;

  • permitted commercial use; and

  • affiliate links.

Important Safety Clarification

Three Little Cubs has had specific finished Moses basket products professionally safety tested against BS EN 1466:2023.

This testing applies only to the specific finished products manufactured and supplied directly by Three Little Cubs and to the configuration, materials and components that were tested.

It does not mean that this digital pattern, tutorial, Make Your Own Kit or any finished basket made by another person has been safety tested, certified or approved by Three Little Cubs.

A finished product made by another person must not be represented as having been tested or certified by Three Little Cubs.


12. MAKE YOUR OWN KITS

Make Your Own Kits contain materials, components and/or instructions intended to assist you in making your own finished item.

A Make Your Own Kit is not a finished product.

The finished item is made by the purchaser and may differ depending on materials, components, measurements, crochet tension, workmanship, construction methods and any modifications made by the purchaser.

Any safety testing or certification applicable to specific finished products manufactured directly by Three Little Cubs does not automatically apply to a finished product made by a customer using a Three Little Cubs Make Your Own Kit.

The purchaser is responsible for following the supplied instructions and for determining the suitability and safety of the finished item for its intended use.

Where a Make Your Own Kit is used to create an infant-related product, the maker is responsible for ensuring that the finished product complies with any applicable safety requirements, regulations and standards in the relevant jurisdiction.


13. COPYRIGHT AND INTELLECTUAL PROPERTY

All content belonging to Three Little Cubs, including but not limited to:

  • crochet patterns;

  • written instructions;

  • photographs;

  • videos;

  • tutorials;

  • diagrams;

  • graphics;

  • product designs;

  • website content;

  • logos;

  • branding; and

  • other instructional or creative material

is protected by applicable intellectual property and copyright laws.

Unless expressly permitted in writing, you may not copy, reproduce, distribute, share, upload, resell or otherwise exploit our copyrighted material.

For digital patterns and tutorials, your purchase provides a personal, non-transferable licence to access and use the purchased content in accordance with the applicable Pattern & Tutorial Disclaimer.

You must not:

  • share the digital file with another person;

  • upload it to websites, groups, forums, file-sharing services or social media;

  • reproduce or redistribute the pattern or tutorial;

  • resell the pattern or tutorial;

  • distribute screenshots or photographs of the pattern;

  • translate and distribute the pattern or any translated version;

  • claim the pattern or its contents as your own; or

  • use the pattern or its contents to create and distribute another pattern, tutorial or instructional product.


14. SELLING FINISHED ITEMS MADE FROM OUR PATTERNS

Unless otherwise stated, you may sell small quantities of genuinely handmade finished items made using a Three Little Cubs pattern.

Clear design credit must be given to Three Little Cubs as the original designer.

Permission to sell a finished handmade item does not give you permission to:

  • sell or distribute the pattern;

  • reproduce the pattern;

  • share the pattern;

  • reproduce the tutorial;

  • claim the design or pattern as your own; or

  • create and distribute another pattern based on our instructions or content.

Permission to sell finished items does not constitute approval, safety certification or endorsement by Three Little Cubs of the finished product.

The maker and/or seller remains responsible for the finished product and for complying with all applicable laws, regulations, product-safety requirements, testing requirements, labelling requirements and consumer-protection requirements applicable to the jurisdiction in which the product is made, sold, supplied or used.


15. INFANT AND CHILD-RELATED PRODUCTS

Products and patterns intended for babies and children require particular care and attention.

Where you make an infant-related product using one of our patterns or kits, you are responsible for ensuring that the finished item is appropriate and safe for its intended use.

For Moses baskets and other infant products, you must not assume that a product is safe, certified or suitable for infant use simply because it has been made using a Three Little Cubs pattern or kit.

Where a product is intended for use with an infant, the maker and end user must follow all applicable safety requirements and relevant safe-sleep guidance.


16. THIRD-PARTY LINKS AND AFFILIATE LINKS

Our website and digital patterns may contain links to third-party websites, suppliers or stockists.

We are not responsible for the content, availability, security, products or services provided by third-party websites.

Some stockist or supplier links included within our digital patterns may be affiliate links.

Where applicable, Three Little Cubs may receive a small commission if you purchase through an affiliate link. This does not affect the price you pay.


17. WEBSITE SECURITY AND AVAILABILITY

We make reasonable efforts to maintain the security and availability of our website.

However, we cannot guarantee that the website will always be uninterrupted, error-free or free from viruses or other harmful material.

We are not responsible for loss or damage caused by events outside our reasonable control, including malicious attacks, viruses, technical failures or interruptions to third-party services, except where liability cannot legally be excluded.


18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Three Little Cubs Ltd will not be responsible for losses arising from matters outside our reasonable control.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In relation to finished products made by customers or other third parties using our patterns or kits, Three Little Cubs cannot control:

  • the materials selected;

  • the components used;

  • the workmanship;

  • crochet tension;

  • construction methods;

  • modifications;

  • measurements;

  • how instructions are interpreted; or

  • how the finished product is used.

Responsibility for the finished product therefore remains with the maker and/or seller, subject always to any rights or liabilities that cannot legally be excluded or limited.

Nothing in these Terms & Conditions affects any rights or protections that cannot legally be excluded or limited under the laws applicable to you.


19. PRODUCT COLOUR AND MATERIAL VARIATIONS

Our products may contain recycled or natural materials.

Due to the nature of recycled fibres, colours and textures can vary slightly between production batches.

This means that the shade or contrast between colours may differ slightly from product photographs or previous orders.

Where colour matching is important, we recommend purchasing the required quantity at the same time.


20. PROMOTIONAL OFFERS

From time to time, we may offer promotional discounts or special offers.

Individual promotions may have additional terms, including:

  • promotional periods;

  • product exclusions;

  • minimum spend requirements;

  • discount-code restrictions;

  • limited quantities; and

  • other eligibility requirements.

Where additional promotional terms apply, those terms will be displayed with the relevant promotion and will form part of the terms applicable to that offer.

Promotional discounts cannot be applied retrospectively unless expressly stated.

Only one promotional discount may be used per order unless otherwise stated.

We reserve the right to withdraw or amend a promotion where reasonably necessary. Any changes will not affect orders already successfully placed using a valid promotional offer.

Your personal information is handled in accordance with our Privacy Policy.

We may share relevant delivery information with third-party delivery and fulfilment providers where necessary to fulfil your order and provide delivery updates.


22. GOVERNING LAW AND JURISDICTION

These Terms & Conditions are governed by the laws of Scotland.

If you are a consumer, you will also benefit from any mandatory consumer protections provided by the laws applicable to you that cannot legally be excluded or limited by agreement.

Where permitted by law, disputes will be subject to the jurisdiction of the courts of Scotland.


23. GENERAL

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

Failure by us to enforce any provision of these Terms & Conditions does not constitute a waiver of our right to enforce that provision in the future.

These Terms & Conditions, together with any applicable product-specific terms, policies and promotional terms, form the agreement between you and Three Little Cubs Ltd in relation to your use of our website and purchase of our products.


24. Delivery and Processing Times

Made-to-Order Crochet Products

Made-to-order crochet products are produced specifically for each customer. The current estimated turnaround time for made-to-order crochet products is displayed at the top of our website at the time of purchase.

We always do our best to complete orders as quickly as possible and may dispatch orders sooner than the stated timeframe. However, stated turnaround times are estimates and are not guaranteed unless expressly confirmed otherwise.

DIY Kits
The current estimated processing and delivery timeframe for our DIY Kits is displayed on the relevant DIY Kits page at the time of purchase.

We always do our best to dispatch DIY Kits sooner than the stated timeframe where possible. However, the stated timeframe is an estimate and is not a guaranteed delivery date.

In-Stock Products
In-stock products, including changing mats and other ready-to-dispatch items, generally require 3–5 working days for processing before dispatch.

Please note that we sell products across multiple sales platforms, including our website and Etsy. On occasion, an item may sell on another platform before our website stock level has been updated. This means that an item shown as available on our website may, in rare circumstances, be temporarily out of stock.

If this occurs, we will contact you as soon as possible after receiving your order to let you know and will provide an estimated timeframe for when the item is expected to become available.

We will always do our best to minimise any delay and keep you informed of any changes to the expected timeframe.
